Impeach Bush

In the Washington Post, George McGovern opines:

Bush and Cheney are clearly guilty of numerous impeachable offenses. They have repeatedly violated the Constitution. They have transgressed national and international law. They have lied to the American people time after time. Their conduct and their barbaric policies have reduced our beloved country to a historic low in the eyes of people around the world. These are truly “high crimes and misdemeanors”…

The basic strategy of the administration has been to encourage a climate of fear, letting it exploit the 2001 al-Qaeda attacks not only to justify the invasion of Iraq but also to excuse such dangerous misbehavior as the illegal tapping of our telephones by government agents.

I sympathize with McGovern to an extent, but believe that his appeal to the Constitution is misguided, at best.

At the end of the day, the men who comprise the government are the ultimate arbiters of whether that document can or cannot control their actions. Over two hundred years of history suggest that it has never really been able to do the one thing it was designed to do: limit the government, and protect the people. This is probably because it is an inanimate piece of parchment that A) cannot enforce itself (by virtue of being an inanimate piece of parchment) and B) is unlikely to be enforced by the people comprising government (by virtue of the benefits they stand to gain by violating it).

Lysander Spooner once said that, “[T]he Constitution has either authorized such a government as we have had, or has been powerless to prevent it. In either case, it is unfit to exist.” Almost a hundred and forty years later, Spooner’s proclamation is no less true.
